By accessing or using the WNC Trout Predictor application and website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
WNC Trout Predictor is a web-based application that provides real-time fishing condition estimates for trout streams in Western North Carolina. The Service aggregates publicly available data from the U.S. Geological Survey (USGS), Open-Meteo weather services, and other sources to generate bite quality scores, hatch predictions, and fishing recommendations.
Access to the application requires a paid subscription. Payments are processed securely through Stripe, Inc. By subscribing, you authorize recurring charges at the stated subscription rate until you cancel. You may cancel at any time through your Stripe customer portal or by contacting us directly. No refunds will be issued for partial billing periods.
Your subscription grants access to a single individual. You may not share your login credentials or access password with others. We reserve the right to change the access password at any time, in which case active subscribers will be provided the updated credentials.

All content, code, design, scoring algorithms, hatch databases, stream knowledge, and editorial commentary within the WNC Trout Predictor are the intellectual property of the owner and are protected by U.S. copyright law. The scoring methodology, weighted factor system, and stream-specific calibration data represent proprietary trade secrets.
The Service provides estimates and predictions based on environmental models and publicly available data. Bite quality scores, hatch predictions, flow assessments, and all other outputs are estimates only and are not guaranteed to be accurate. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WNC TROUT PREDICTOR AND ITS OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or notice within the application. Continued use of the Service after changes constitutes acceptance of the updated Terms.
We may terminate or suspend your access at our discretion for violation of these Terms. You may terminate your subscription at any time by canceling through Stripe or contacting us.
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Buncombe County, North Carolina.
